WSTA has always utilized Evilsizor Process Servers based in Colorado for the past 12 years as they only charged a one-time filing fee (no annual fee). They are changing their policy on BOC-3 filings and you must act to maintain your federal operating authority. Here is the message we received from Evilsizor:
Due to the amount of summons and other court documents we serve on a daily basis we will be charging annual fees for our BOC service. Here’s why. More and more carriers, freight forwards and brokers are getting sued. Yesterday I sent the FMCSA letters to have our name removed from 35 accounts who we served but never paid. We have expenses to the process agent receiving the documents plus time and postage on our end to be sure the customer receives the court documents. This comes at a minimum loss of $3500. We can no longer absorb this kind of loss. We will still continue to charge the $99 service fee if the client is served but will also charge an annual fee as well to be sure the BOC is current.
Here’s how it’s going to work…
For BOCs issued in 2024 the renewal date will be 6/30/2025. We will be emailing the client and/or agent about the renewal 60 days prior to the expiration date. We know this will be a massive project and will do the best we can to keep up with all of our clients.
BOCs issued prior to 1/1/2024 will be expected to renew by 6/30/2024 and then be set on an annual basis from there to avoid removal of the filing.

Failure to act will result in the removal by Evilsizor of your form BOC-3, which will in turn cause your federal authority to be revoked by FMCSA. You would then still need to file a new BOC-3 and pay FMCSA a fee of $80 to reinstate your authority. If you do not have your US DOT PIN, getting your authority reinstated could take up to two weeks since paper forms would then need to be submitted to FMCSA.
The association has looked into other options for BOC-3 providers and it is common for many to charge an annual fee, some as high as $165. We did find a couple of service providers claiming to charge a one-time fee but we fear the annual fee will become the industry norm as Evilsizor is one of the oldest and biggest providers of this service. We are not comfortable recommending any alternative to Evilsizor.
